Metro Graphics - Terms of Service

1. Agreement
By placing an order or using any service provided by Metro Graphics ("we," "us," "our"), you ("client," "you") agree to these Terms of Service. We reserve the right to update these terms at any time with notice provided via email or your client portal.
2. Services
Metro Graphics provides web hosting, domain registration, and related services. All services are provided on a subscription basis and are subject to availability. We reserve the right to modify, suspend, or discontinue any service with reasonable notice.
3. Payment and Billing
All fees are due upon invoice. Payments are processed securely via Stripe. Recurring services will be invoiced automatically according to your selected billing cycle. Prices are subject to change with 30 days' notice.
4. Late Payment and Suspension
Accounts with unpaid invoices past their due date may be suspended without further notice. Suspended accounts will be reactivated upon payment of all outstanding balances. Accounts suspended for more than 30 days may be terminated and data deleted permanently.
5. Cancellations and Refunds
You may cancel your service at any time from your client portal. Hosting services are non-refundable after provisioning. Domain registrations are non-refundable once registered. If you experience a service outage attributable to our infrastructure, you may request a pro-rated credit at our discretion.
6. Acceptable Use
You agree not to use our services for any unlawful purpose, including but not limited to: distributing malware, sending unsolicited bulk email (spam), hosting phishing sites, copyright infringement, or any activity that disrupts other clients or our infrastructure. Violation of this policy may result in immediate termination without refund. Acceptable Use Policy.
7. Account Responsibility
You are solely responsible for maintaining the security of your cPanel login credentials and any content hosted on your account. Metro Graphics is not liable for unauthorized access resulting from your failure to secure your credentials.
8. Backups
We perform periodic server-level backups as a courtesy, but we do not guarantee backup availability. You are solely responsible for maintaining your own backups of all data, files, databases, and email. Metro Graphics is not liable for any data loss.
9. Uptime and Service Levels
We target 99.9% network uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. Unplanned outages are not grounds for refund except at our sole discretion.
10. Domain Registration
Domain registrations are subject to the terms of the applicable registrar and ICANN policies. Metro Graphics acts as a reseller and is not responsible for registrar-level decisions, including domain disputes or transfers initiated by third parties.
11. Limitation of Liability
Metro Graphics is not liable for any indirect, incidental, or consequential damages arising from your use of our services, including but not limited to lost revenue, lost data, or business interruption. Our total liability to you shall not exceed the amount paid for the affected service in the prior 30 days.
12. Governing Law
These terms are governed by the laws of the State of Maryland, United States. Any disputes shall be resolved in the courts of Montgomery County, Maryland.
